Apple attacks Nokia, Psystar does some legal stuff against Apple, Earth keeps turning

Blah blah blah. More lawsuits. Anyway, Apple is after Nokia for patent infringement after Nokia sued over infringement against Apple. The Nokia case is over some smartphone technology and is a reaction to Nokia's request that Apple stop exporting the iPhone, iPod, and MacBooks.

We can't say we're surprised, considering AT&T lost its request to have Verizon's ads pulled down for the holidays -- spending money to litigate this further would have have simply been a waste, and generated even more bad PR. Now let's just hope these two suck it up and battle it out over service quality and pricing, like they should have been doing all along. Or AT&T can just make some more nonsensical Luke Wilson commercials, whatevs.
Update: Whoa, so this is crazy. We just checked out the other suit that was dismissed, and it turns out that Verizon actually sued AT&T back in July, but not for any damages -- instead, Big Red asked the court to rule that its various "Most Reliable 3G Network" taglines were actually true. That wackiness certainly explains why AT&T felt the need to push back, we suppose, and it makes Verizon's current whining over Sprint's "Most Dependable 3G Network" claims part of a larger, lamer pattern. Psystar settles with Apple to the tune of $2.7 million (but won’t pay up just yet)

(That's a partial settlement, not court-mandated or anything.) Go ahead and go to its Web site: everything is out of stock!

Apple has been given a permanent injunction against Psystar, preventing the company from selling Hackintoshen and their Rebel EFI software. The company has been accusing of "trafficking in circumvention devices."

Texas Judge rules Microsoft can’t sell Word anymore

Go ahead and clean up the coffee you just spit all over your keyboard. We'll wait. Back? OK. A judge and Texas as ruled that Microsoft Word's XML systems violate patents by Toronoto-based i4i Inc. Word uses XML in reading and writing XML, DOCX, and DOCM files.
The lawsuit alleges that MS violated i4i's 1998 XML patent #5,787,449. The injunction will go into effect in 60 days and prevent Microsoft from selling or demonstrating Microsoft Word. MS will have to pay i4i about $290 million in damages.

Tenenbaum ordered to pay $675,000 to record labels

Pirate Bay fires its copyright-busting cannon at YouTube

Supposedly, the The Pirate Bay guys were found guilty in their recent trial in Sweden, and, supposedly, they got sentenced to a year in prison and had to pay $4.5 million in damages.
But back in the parallel universe which happens to be the real world, they've appealed the verdict and could probably keep doing so for the next few years. So in the meantime they need to keep busy, and what better way to do this than start a new user driven video portal to take on YouTube, called, predictably, Video Bay, allowing users to post and share video clips without having to worry about copyright violations. Seems reasonable. It's not like they need to attract any more legal interest or anything.

24 songs: Woman ordered to pay $1.92 million to RIAA

Get this: a woman in Minneapolis, Jammie Thomas-Rasset, has been ordered to pay $1.92 million in damages for downloading and sharing 24 songs. That works out to about $80,000 per song. Clearly the RIAA deserves props. Mad props.

Psion relents: ‘netbook’ ok to describe chubby cheap laptops lacking power

As the world's attention turns from netbooks to smartbooks, Psion and Intel have ceased battle over use of the former term. Remember, this ridiculous case escalated to the point of Psion claiming $1.2 billion (billion!) in damages suffered as a result of infringement on its netbook trademark for a product few have heard of outside of the highly specialized supply chain logistics area. The "amicable" agreement reached with Intel has Psion voluntarily withdrawing its trademark. What wasn't said in the press release is how much money was extorted from the industry or the net effect on Psion sales from all the free publicity. Regardless, we're sure it's been a profitable exercise for Psion Teklogix. Now, could the obscure owner of the "smartbook" trademark please step forward to collect your prize?

AT&T / Cingular class action gets go ahead from federal court

This one goes back a little ways, but a U.S. District Court in Seattle has now given the go ahead to a class action lawsuit brought by former AT&T Wireless subscribers, who have complained that their service went downhill after the company was bought by Cingular and ultimately became the new AT&T. They're also not too happy that they were forced to pay to get new Cingular phones, and they're now asking that AT&T pay back all those extra charges, plus the usual damages, of course. For its part, AT&T isn't saying anything more than that it "respectfully" disagrees with the court's decision, and that it's now studying the ruling and considering its options.Filed under: Cellphones
