Court sides with Apple, those dudes at Psystar are hosed

Apple's charges of copyright infringement and DMCA violation against Psystar have stuck and, friends, things ain't pretty for the two brothers in Miami. The problem with Psystar's approach wasn't that they were crazy for trying it. It's that the were selling a counterfeit unit.
Apple contends that Psystar has violated its distribution right by offering and selling Mac OS X on Psystar computers to the public. Psystar admits that it has distributed Mac OS X (Chung Exh. 17 at 4). But Psystar responds that its conduct is protected by the Section 109 first-sale doctrine. Section 109 provides that "the owner of a particular copy or phonorecord lawfully made under this title, or any person authorized by such owner, is entitled, without the authority of the copyright owner, to sell or otherwise dispose of the possession of that copy or phonorecord." 17 U.S.C. 109. This provision is a limitation on the distribution right. It applies only to an owner of a copy.

Sony kills (for now, at least) UMD transfer program for PSP Go
Posted on September 25, 2009 | No CommentsOh, Sony. You're so close to being back, and then this happens. As you all know, the PSP Go comes out next week, and judging by all the random unboxings I've seen on various message boards—maybe our PSP Go got lost in the mail? Oh, well.—it looks like a fine, fine piece of hardware. The kicker, though, is: what happens to all those UMD games we've bought over the years? The original plan was to have some sort of trade-in or transfer program, whereby for every UMD you bought, you'd get a code to download the game. (Remember, there's no UMD slot in the PSP Go, so all games have to be downloaded onto the device's memory.) Turns out there's a small glitch.

Police try to trick hackers, with hilarious results

Police in Australia thought they were being mighty clever when they took over an “underground hacking forum.” (The forum is r00t-y0u.org, though it seems to be down right now.) One of the hackers on the forum then retaliated by breaking into police computers using a simple SQL injection. Security fail.

Judge: RealDVD is totally illegal as per the DMCA

Nope, it was also the date when a judge in San Francisco ruled that RealDVD was illegal, and reiterated that it was illegal to manufacture or traffic software that makes it possible to copy DVDs. So, every time you fire up DVD Copier on your PC, make a copy of a DVD that you bought, well, you're breaking the law. The DMCA just keeps on giving, doesn't it?
