    AT&T sued by Washington DC for unused balances on calling cards

    Here's a superficially curious, but fundamentally quite important, bit of legal wrangling for you. Reuters is reporting that the District of Columbia has filed suit against AT&T Corp for the recovery of unused balances on calling cards purchased from the telecom giant. Estimated at somewhere between 5 and 20 percent of the overall value of the cards, the so-called breakage -- leftover credit that customers neglect to use -- has typically remained with the carrier as a sort of predictable bonus. The DC Attorney General, however, is seeking to have breakages treated as unclaimed property, which under district law means that after three years they must be returned to the state. Whichever side of the fence you sit on, the decision on this case will set a significant precedent for the future of such prepaid services.

    The courts say don’t blame Apple if your iPod caused you to go deaf

    The Ninth Circuit Court of Appeals in San Francisco upheld a 2008 ruling that stated the iPod does not pose an unreasonable risk for hearing loss even though everyone knows the old stock iPod earbuds were the worst earbuds ever made. (I added that last part) The original case augured that because the iPod earbuds were designed to sit so far back in the ear, and the iPod itself does not have any volume meters or noise-isolating properties, that the device could be made safer. But the courts just told the plaintiffs to shut-up and sit down.

    The Myinee Abbee will record FM radio to a portable player (too bad FM radio stinks)

    So I just stumbled upon the Myinee Abbee. It's a combination FM radio+portable music player. The idea is simple enough: you tune the radio into a station, plug in the portable music player, then it records the audio directly to said player. Now you can walk around with a collection of songs that an overpaid, out-of-touch program director has put together based on his company's national playlist. Wonderful.

    webOS 1.3.1 trickles out to European Pres

    A Europe with a Yahoo-free webOS isn't a Europe we'd ever want to live in -- it's just not right -- and happily we won't have to, because that shiny new version 1.3.1 that dropped in concert with the Pixi launch a few days ago is on the way to the Old World. Palm's official blog reports that customers on the Pre's official carriers in Ireland, Germany, Spain, and the UK can expect 1.3.1 "soon," and thanks to the magic of over-the-air firmware delivery, users should have little more to do than sit on their rears and wait for the goodness to come to them on a wireless silver platter. In fact, we've heard from one German tipster that the update is already available. Let us know how it treats you, won't you?

    T-Mobile (along with a number of overseas carriers) have had RIM's BlackBerry Bold 9700 for some time now, and while we knew that the handset was shipping to those who AT&T considers "special" and "irreplaceable," the rest of the collective masses have simply had to sit on the sidelines and wait. Thankfully, that whole bout with patience is over, as the Bold 9700 is now available to order directly from the operator's website for $199.99 after a $100 mail-in rebate and your John Henry on a 2-year agreement. So, anyone forcing Santa to come early this year, or what?

    Amazon finally releases the Kindle for PC app (but it’s still in beta)

    Huzzah! PC users can finally include their computers within the each of Amazon's syncing capabilities with the Kindle for PC app. The just released beta finally gives PC users a viable ebook reading option on a program that doesn't look like it was designed for Windows 95. Although the majority of users will probably be those that already own a Kindle and just want to turn a few pages while at work, still relying on a Kindle for most of the reading. The app is pretty darn powerful in of itself, but there are some notable drawbacks and limitations.
